These Terms of Service (“Terms”) govern your access to and use of the RenewPermit permit-renewal tracking and messaging service (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
RenewPermit helps firearms instructors and businesses track student permit expiry dates and send renewal reminders by SMS and email. We may add, change, or remove features over time.
2. Accounts
You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and able to form a binding contract to use the Service.
3. Your responsibilities for messaging and consent
You control the content and recipients of the reminders and messages you send through the Service. You represent and warrant that:
- You have obtained all consents required by law — including the Telephone Consumer Protection Act (TCPA) and applicable state laws — before sending SMS or email to any recipient through the Service;
- You will honor opt-out requests (such as STOP replies and email unsubscribes) and will not message anyone who has opted out;
- You will use the Service only for lawful purposes and only to contact your own students or clients about their permits and your services; and
- You will comply with mobile carrier requirements, including A2P 10DLC registration and messaging policies.
You are the sender of your messages. You are solely responsible for your messaging practices and their content.
4. Acceptable use
You agree not to: send spam or unsolicited messages; upload unlawful, harassing, or infringing content; attempt to access accounts or data that are not yours; interfere with or disrupt the Service; or use the Service to violate any law or third-party rights.
5. Fees and billing
Paid plans are billed on a recurring basis as described at sign-up. Unless stated otherwise, fees are non-refundable except where required by law. We may change pricing on a going-forward basis with notice; any founding rate that is described as “locked” will be honored according to its stated terms. You can cancel at any time, and cancellation takes effect at the end of the current billing period.
6. Customer data
You retain ownership of the data you enter into the Service. You grant us the rights needed to host, process, and transmit that data to provide the Service. Our handling of personal information is described in our Privacy Policy.
7. Third-party services
The Service relies on third parties for messaging delivery, hosting, and payment processing. We are not responsible for the acts or omissions of these providers or for message delivery delays or failures outside our control.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that reminders will be delivered on time or that the Service will be uninterrupted or error-free. You are responsible for verifying permit dates and renewal requirements; the Service is a tool and not legal or compliance advice.
9. Limitation of liability
To the maximum extent permitted by law, RenewPermit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising out of or related to the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless RenewPermit from claims, damages, and expenses arising out of your use of the Service, your messages, or your violation of these Terms or applicable law — including any claim that a message you sent lacked required consent.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that creates risk or legal exposure. Upon termination, your right to use the Service ends; sections that by their nature should survive will survive.
12. Governing law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in Tennessee, and you consent to their jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Service after changes take effect means you accept the updated Terms.
